Tea Party Patriots Action Agrees with Archivist and the Law: Biden Is Wrong on ERA

Atlanta, GA – On Friday, President Biden declared that he believes that the Equal Rights Amendment has met the requirements of ratification and therefore is now part of the Constitution. The archivist of the United States, a Biden appointee, has until now refused to formally publish the amendment on the grounds that it has not met Constitutional requirements. In response, Tea Party Patriots Action Honorary Chairman Jenny Beth Martin issued the following statement:
“Joe Biden’s declaration that he believes the Equal Rights Amendment has been ratified by 38 states is, like so many of the things he has said over the course of a 50-plus year career, simply wrong. This desperate last-minute attempt to curry favor with so-called ‘women’s groups’ is laughable on its face, especially coming from the leader of a political party many of whose leading lights, including its most recent Supreme Court nominee, cannot define what a ‘woman’ is in the first place.
“Less than a month ago, the two senior officials of the National Archives — Biden appointees — released a statement declaring their firm stance that the proposed amendment has not met the requirements for ratification. Their stance relies, as they point out, on, among other things, legal opinions written by the Office of Legal Counsel in the Department of Justice in 2020 and 2022, again under the direction of Biden’s own appointees.
“The Archivist is right. The law is clear.
“Biden’s statement has no legal force. It is nothing more than a last-ditch attempt to woo certain elements of the American body politic. Like so much of what he has attempted, it, too, will fail.”
